Can we inspect the auction properties?

You are certainly free to drive to any of the properties and view them from the highway. Due to liability reasons, the county gives no one permission to enter any of the premises. By the same token, we don't patrol these properties unless there is a report of vandalism or theft. You are on your own as far as inspections go. Good luck at the auction if you decide to bid.

 

Is the online catalog current?

Our website is updated daily. What you see is posted for auction as of today. Any time a parcel is bought back by the prior owner our list is updated to reflect that change. After September 4th there should be no more changes until auction.

 

Are there any liens on the properties?

The county does not list liens. If all parties have been properly notified, the liens (other than Fed or State) are eliminated by the foreclosure action and therefore no longer exist at the auction. If notice is not properly given, liens can sometimes be reinstated. That's why all our rules make no warranties. Liens can only be researched in person at the Oswego County Clerk’s Office, 46 E Bridge St., Oswego. The clerk supplies instructions for doing this research.

 

What is the county’s interest in the property?

The county takes title as a result of tax enforcement. We do not enter the premises nor do we evict or manage these properties in any way. We simply take title and then sell title. The buyer assumes all risks.

 

What is your payment policy?

As per the "Auction Policy" as stated on our web site,

 

(3) A closing bid of $1,000 or more must be accompanied by a check or cash for $1,000 or 10% of the final bid, whichever is greater, plus a 5% buyer’s premium and $300 administration fee. The balance (if any) is due and payable in full by cash, cashier's check or certified funds, within 30 days of signing of a purchase contract at auction. Failure to submit such closing balance within this 30-day time limit shall result in forfeiture of deposit(s), forfeiture of any fees paid to date and forfeiture of any rights to the buyer contained in such purchase contract resultant from a successful bid.

 

(5) A closing bid of less than $1,000 must be accompanied by a check or cash for payment in full plus a 5% buyer's premium and $300 administration fee.

 

Your deposit on auction day may be by personal check or cash. The balance within 30 days must be by certified check or cash. The type of deed from the county is labeled a "tax deed". It's the same as a "quit claim deed".

What about occupied properties?

The county does not evict. The successful bidder receives the property "AS IS" including any tenants or prior owners who may still be living there. Thus, it's up to the successful bidder (new Owner) to evict or whatever!

 

What is the equalized value?

As explained in the "Auction Catalog Reference Guide", Equalized Value, this is the assessor’s estimate of market value, using the assessed value divided by equalization rate.

 

Are the taxes paid for on the properties?

Town, County and School taxes are paid by the county and will be current at auction. Thus, the successful bidder will owe no town, county or school back taxes. HOWEVER, if the property is located within the CITY of Oswego or within one of the 9 VILLAGES in this county, there MAY be CITY or VILLAGE back taxes due. In such event, the amounts will be noted when the property is brought up for sale.

 

What is the minimum bid?

There is no minimum bid.  All bidding starts wherever it starts.  All properties will be sold to the highest bidder regardless of price.  Delinquent taxes are no bearing on the starting or ending bid.

 

Do I have to be there in person?

You may have a representative bid for you.  Your representative will need to provide identification as defined in our policy.  He/she will also need to have your name spelled out as you wish to have it appear on the deed along with your social security number.  Your representative will be held responsible for any issues arising at auction or as a result of the auction until title is conveyed to you.  There is no provision for on-line or sealed bidding.  You or your representative must be present to bid.
